What is DOT drug and alcohol testing?

The U.S. Department of Transportation (DOT) requires safety-sensitive employees — including CDL drivers — to undergo drug and alcohol testing as a condition of employment. Testing is required pre-employment, randomly throughout the year, after accidents, upon reasonable suspicion, and as part of the return-to-duty process.

Which substances are tested under DOT regulations?

DOT drug tests screen for marijuana (THC), cocaine, amphetamines (including methamphetamine and MDMA), opioids (codeine, morphine, heroin, oxycodone, oxymorphone, hydrocodone, hydromorphone), and phencyclidine (PCP). Alcohol testing measures breath alcohol concentration (BAC).

What happens if I test positive or refuse a DOT test?

Accepted Answer

A positive test result or refusal to test immediately removes you from safety-sensitive duties. You are required to be evaluated by a DOT-qualified Substance Abuse Professional (SAP), complete any recommended education or treatment, and pass a return-to-duty test before resuming safety-sensitive work. Refusal to test is treated the same as a positive result.

Does a positive marijuana test disqualify me even if it's legal in my state?

Yes. DOT regulations are federal law and do not recognize state marijuana laws. A positive marijuana test result has the same consequences as any other positive DOT drug test, regardless of whether marijuana is legal in your state.

Question 5

What is a Substance Abuse Professional (SAP)?

A SAP is a licensed professional qualified under 49 CFR Part 40 to evaluate employees who have violated DOT drug and alcohol regulations. The SAP recommends an appropriate course of education or treatment, monitors compliance, and conducts a follow-up evaluation to determine whether the employee is ready to return to safety-sensitive duties.

Do I have to use a DOT-qualified SAP?

Accepted Answer

Yes. Only a DOT-qualified SAP can complete the evaluation and sign off on your return-to-duty process. Using a counselor or therapist who is not DOT-qualified will not satisfy the federal requirement, and your employer cannot legally return you to safety-sensitive duties without a SAP's clearance.

How long does the SAP evaluation process take?

The timeline varies depending on the SAP's recommendations. The initial evaluation typically takes one session. If education or treatment is recommended, you must complete those requirements before a follow-up evaluation. The entire process can range from a few weeks to several months depending on the level of care prescribed.

Question 8

Who pays for the SAP evaluation and treatment?

In most cases, the employee is responsible for the cost of the SAP evaluation and any recommended treatment. Some employers may cover part or all of the cost through an Employee Assistance Program (EAP) or company policy. We offer sessions at $50 per session to keep the process as accessible as possible.

What is the return-to-duty process?

The return-to-duty process is a federally mandated series of steps a DOT-regulated employee must complete after a drug or alcohol violation before resuming safety-sensitive duties. It includes: (1) SAP initial evaluation, (2) completion of recommended education or treatment, (3) SAP follow-up evaluation and clearance, (4) a negative return-to-duty drug/alcohol test, and (5) unannounced follow-up testing for up to 5 years.

Can I drive a commercial vehicle while going through the return-to-duty process?

Accepted Answer

No. You are prohibited from performing any DOT safety-sensitive functions — including driving a commercial motor vehicle — until you have received SAP clearance and passed a return-to-duty drug and/or alcohol test. Driving during this period is a serious federal violation.

Question 11

What is follow-up testing and how long does it last?

Accepted Answer

After you return to safety-sensitive duties, your employer is required to conduct unannounced follow-up drug and/or alcohol tests. The SAP determines the minimum number and frequency of tests — at least 6 tests in the first 12 months. Follow-up testing can continue for up to 60 months (5 years) at the SAP's discretion.

What if I change employers during the return-to-duty process?

Your DOT drug and alcohol violation history follows you. Any new DOT-regulated employer is required to obtain your drug and alcohol testing records from previous employers (going back 3 years). You must complete the return-to-duty process before any new employer can place you in a safety-sensitive position.

What are my obligations as a DOT-regulated employer?

DOT-regulated employers must maintain a written drug and alcohol testing policy, enroll safety-sensitive employees in a DOT-compliant testing program, conduct required testing (pre-employment, random, post-accident, reasonable suspicion, return-to-duty, and follow-up), and refer employees who violate the policy to a qualified SAP. Failure to comply can result in significant fines and loss of operating authority.

Can I return an employee to safety-sensitive duties before the SAP process is complete?

Accepted Answer

No. An employer who returns an employee to safety-sensitive duties before the SAP has issued a return-to-duty clearance and the employee has passed a return-to-duty test is in direct violation of federal regulations. This can result in civil penalties and jeopardize your company's operating authority.

Do you work with employers and fleet managers directly?

How much do sessions cost?

Accepted Answer

Sessions are $50 per session. We also accept insurance co-pays. We believe cost should not be a barrier to completing your return-to-duty requirements, and we work to keep our services accessible to all drivers.

Do you offer online sessions?

Yes. We offer secure online video sessions for clients who cannot attend in person or prefer the convenience of remote counseling. Online sessions meet all DOT requirements and are available by appointment.
